Construction Law

We advise on all aspects of claim procedures as well as claim preparation and enforcement (or defence) strategies; advice on assessment and formulation of delay and disruption claims. We advise on local and international infrastructure disputes, arbitration and mediation.
We advise clients on all their construction-related legal needs, from the drafting of the tender, procurement and project documentation to the resolution of disputes arising out of construction projects. With a client base that spans governments, energy and utility companies, lenders, developers, international and domestic main contractors, international and
domestic specialist sub-contractors; we offer clients insight into the shifting commercial and legal landscape. We have advised on various infrastructure projects and also acted as a Sole Arbitrator in various Construction Disputes. Our experience covers all major sectors including infrastructure, process plants, power, mining and metals and commercial property.

Commercial Litigation

We have a reputation for producing excellent results for our litigation clients. Since 1996, the firm has an excellent track record in winning for our clients in commercial disputes. The Firm has built effective litigation machinery that actively involves all advocates; this machinery ensures formulation of accurate legal strategies and efficient modes of execution.

In litigation, we represent clients before courts at all levels. Since we are more interested in arriving at a commercially sound conclusion for our clients, we also advise clients on arbitration proceedings and other forms of intermediate and alternative dispute resolution where the need arises.

Arbitration

We advise clients on both domestic and international arbitration proceedings and other forms of intermediate and alternative dispute resolution, as well as on contract management of claims arising during the course of a project.

Our team helps clients weigh the merits of litigating against using arbitration or other types of ADR procedures. We also engage in the drafting of arbitration agreements tailored to each client’s circumstances. With a properly constructed dispute resolution clause, the arbitration agreement can form the basis for enforceable contracts and arbitration awards in multiple jurisdictions.
Our clients include Statutory Bodies, State Enterprises, Government Parastatals, Corporations and Individuals. Our strength includes our Senior Partner, David Kaggwa who is a Fellow of the Chartered Institute of Arbitrators of London. He has been appointed as sole Arbitrator in several matters involving; Uganda National Roads Authority, Uganda Revenue Authority, Uganda Development Corporation, where he has delivered excellent awards that have been enforced by the Courts.
