JOHN.K.KAGGWA
Managing Partner

John Kizito Kaggwa is currently the Managing Partner of the firm. He has over 28 years’ experience having acted for Bank of Uganda, , Barclays Bank Uganda Limited, Total Uganda Limited among other notable organizations. John is also highly experienced as a transactional lawyer and is currently specialized in representing multi-national companies engaged in the fields of infrastructure, mining and manufacturing. He has extensively negotiated exploration licenses, mining leases, concession agreements, supply and off-take contracts, tolling agreements, interface agreements and construction contracts.

John’s experience

  • Advised in the incorporation and formation of Uganda Securities Exchange between 1990-1991 under the supervision of the former Central Bank governor.
  • Advised in the merger that formed the first mobile services provider in Uganda and also further advised it on acquisition of assets and construction of the first base stations in Uganda between 1993 to 1996.
  • Advised a construction company on legal and procurement compliance requirements for the road sector in Uganda which enabled it secure a contract to build a road in a project worth USD 137m.
  • Represented and advised a group of investors from Greece in incorporation of a leading coffee exporting company in Uganda and further advised on compliance with government requirements for the exporting industry between 1998 to 2000.
  • Advised a handset-manufacturing company from China together with a leading telecom company in South Africa in setting up markets in Southern Africa.
  • Advised a leading mining company in Africa established in the United Kingdom on Gold mining investments worth USD 7 Million between 1996 to 2008.
  • Acted as lead legal advisor of a consortium of construction companies; consultancy companies and the government of DRC in structuring finance for the construction of an airport in DRC in 2008.
  • Advised a leading mining company on buy-out of a license for Chromites in a transaction worth USD 350,000.
  • Advised a multi-faceted pan- African company operating in DRC, South Africa, Zambia and Uganda, on various Investment opportunities in finance, energy, transport, and logistics in Uganda.
  • Conducted due diligence and provided legal and regulatory advisory to a client in setting up an ethanol plant in Uganda and further negotiated financing worth USD 23 Million from African Development Bank on behalf of the same client.
  • Advised an energy solutions corporation, based in South Africa, on an infrastructure project valued at USD 1.5 Billion.
  • Advised a Hong Kong-based drilling company on a contract with CNOC to construct campsites worth USD 5 Million.
  • Advised a South Korean corporation on construction project of an Airport in Uganda with a project value of Euros 4.2 Million.
  • Advised a South Korean corporation on various infrastructure projects in Rwanda.
  • Advised an IT company established in Azerbaijan on designing and supplying unique IT solutions to the government of Uganda in a transaction valued USD 10 Million.
  • Advised Innolead Consulting, a consulting firm based in Botswana, on its Oil & Gas service provider’s registration in Uganda.
  • He is a Corporation Secretary in a leading mining corporation.
  • He is a Corporation Secretary of Majestic Brands Limited which is mandated to promote the Buganda Kingdom Brand and generate revenue from investment.

DAVID.S.KAGGWA
Senior Partner

David is a Senior Partner at the Firm with over 12 years’ experience in Construction law, arbitration and commercial litigation. David is an expert in the FIDIC Suite of contracts published by the International Federation of Consulting Engineers, the NEC Engineering and Construction Contract (NEC) created by the Institution of Civil Engineers of United Kingdom and the Joint Contracts Tribunal contracts. David is currently involved in numerous Multi-Billion contract Litigation, Construction and Dispute Resolution. He is also experienced in all fields of commercial litigation and alternative dispute resolution, including international arbitration and mediation.

In June 2011, David was appointed by the Judiciary of Uganda as a member of a task force which successfully formulated the Judicature (Mediation) Rules, 2013 to be applied to all Divisions of the High Court. He has trained 50 Advocates as Mediators and over 200 Advocates in Trial Advocacy. David has authored and presented several notable papers in the Construction Industry including ‘Sustainability of the Construction Industry through Alternative Dispute Resolution’ that was presented to the Botswana Institute of Engineers.

David is a holder of a Master of Laws degree (Construction Law and Arbitration) from the Robert Gordon University – Aberdeen Scotland. He is a Fellow of the Chartered Institute of Arbitrators [FCIArb] UK, which is the most senior level of membership of one of the oldest and most prestigious professional organisations in the world. David is a member of the London Court of International Arbitration and he has successfully delivered arbitration awards that have been enforced by the Court.

  • Appointed Sole Arbitrator in several commercial disputes.
  • Represented Amnesty International together with Clifford Chance acting as Co-counsel in successfully defending a multi-million dollar case in Uganda.
  • Representing Portland Steel International, a South African steel manufacturing Company in a Dispute worth USD 2 million in Uganda.
  • Representing an International Chinese construction company in recovering USD 5 million from a Hotel in Uganda.
  • Representing an International Chinese construction company in a dispute before the Public Procurement and Disposal of Assets of Uganda.
  • Advising an International Chinese construction company in a construction contract with NSSF Uganda worth USD 10 million.
  • Representing a civil engineering firm in a construction dispute against the Government of Uganda.
  • Representing Emerald Hotel Limited in a financial and construction dispute against Barclays Bank in a dispute worth over USD 3.2 million.
  • Represented Scorpion Holdings against Lion Assurance Company in an indemnity dispute involving damage to construction equipment.
  • Represented a global carrier in a commercial dispute against a local construction company worth USD 2m.
  • Representing an Architectural firm, Eco Shelter and Environmental Consultants in a construction dispute against Uganda Post Limited.
  • Representing VAS Garage, a Value Added Services Provider against MTN Uganda Limited in an anti-competition claim with the Uganda Communications Commission in a dispute worth over USD 8 million.
  • Representing DHL Global Forwarding in various commercial disputes worth over US $ 5,000,000.

NICHOLAS MBABAZI
Partner (Head of Business Developments)

Nicholas is a Partner at the Firm heading the Business arm of the firm. He is a corporate generalist lawyer with substantial legal experience. He has high premium on providing pre-emptive legal support. As a Business Developments Partner, Nicholas is primarily in-charge of scouting for opportunities and creating, maintaining and overseeing the firm’s relationships with its Clients. He has worked with Kaggwa & Kaggwa Advocates as an Associate since 2013 up to 2018 when he was named Partner.

SAM OGWANG
Partner (Head of Litigation)

Sam is a Partner at the Firm heading the Litigation Department. Sam started out his career in 2011 with Basaza Wasswa & Co. Advocates as a Legal Assistant. He joined the firm in 2014 as an Associate becoming a Senior Associate in 2016 and Partner in 2018. He has successfully litigated in several commercial matters. Sam has undergone numerous trainings in Trial Advocacy including one organized by Justice Advocacy Africa in conjunction with the Uganda Law Society which has given him the requisite experience and know-how on how to approach matter being litigated. Sam is also knowledgeable in Tax and advises clients on tax-related matters.

Partner (Head of Corporate Advisory)

Sheila is a Partner in Kaggwa & Kaggwa Advocates heading the Corporate Advisory team. She handles legal due diligences, advises on corporate transactional structuring, commercial operational agreements. She also has an impressive understanding of the local regulatory framework to advise on compliance issues, licensing regimes and issues affecting local and foreign investors. Sheila has done trainings with African Regional Intellectual Property Organization (ARIPO) and she has registered several Copyrights & Trademarks. She is also a Chartered Company Secretary.
